A mother from California crashed with drunk her car on a channel and left her 4 -year -old daughter in the rear seat of the submerged vehicle while she went home to bathe, prosecutors said.

Juliette Marie Acosta, 26, had a level of alcohol in her blood almost three times the legal limit when she allegedly crashed into an irrigation channel on March 8, near Hickman, a small town east of Modesto, according to the district care of Stanislaus County.

The supposedly intoxicated mother left her submerged car, where her daughter, Reagan Herrin, was trapped in the seat of her car. Acosta was “located taking a bath while her daughter remained in danger in the accident scene,” said the prosecutor’s office in the Press statement on Saturday.

Reagan’s uncle, who lives nearby, helped take out his niece from Subaru when the police arrived on the scene, authorities told Sacramento Bee. He even ran to a local hospital, where he died the next day.

Acosta’s lawyer, Gil Hola, denied his client to play a bath later.

“As for the timeline, it is almost impossible to have done both,” he insisted on the Independent. “As for the time, you can’t take a bath while your daughter drowns if she is on her channel, not next to a house … Logically, it simply makes no sense.”

Acosta was initially accused of driving under influence, but prosecutors hit her with additional charges, including murder, Friday.

She was arrested at a San Francisco hotel after trying to flee, and her father was also in custody for allegedly trying to help her escape, according to Sacramento Bee.

“Any suggestion that my client tries to flee is completely false,” said Boose.

Acosta is being a bail, said the Office of the District Prosecutor.

If it is declared guilty, you could face life imprisonment.
